Bad Faith Claims

I will save you the time of reading Georgia codes regarding the handling of claims in bad faith...

33-4-6:  Liability of insurer for damages and attorney’s fees

33-4-7:  Affirmative duty to fairly and promptly adjust in incidents covered by motor 

vehicle liability policies; actions for bad faith; notice to Commissioner of 

Insurance and consumers’ insurance advocate

33-6-33:  Improper claims settlement practices

33-6-34:  Unfair claims settlement practices

....and cut to the chase.  Insurance companies are legally required to act in good faith.  Insurance claims, i.e. total loss and diminished value claims, have to be settled promptly, accurately, and fairly.  Failure to do so can lead to legal action and penalties for failing to adhere to this strict code of conduct.
